Contract Review Services

Do you sign contracts in the delivery of your goods or services?

Contracts are an everyday part of business life. They serve as the mechanism by which your client can take action against you in the event they feel aggrieved. Not surprisingly the contracts are often weighted in favour of your client and place increased and often unreasonable liabilities upon you.

Clients often believe that as they have insurance cover, they are covered for any contractual liability they may enter into. This assumption is not correct.

It is therefore imperative that, before entering into any contract, you obtain the appropriate legal and insurance advice in order that you may understand the exposure and negotiate any amendments to either the contract and/or your insurance protection.

Perrymans, in association with Bastiaan Sparreboom Legal Services, now offer an extended contract review service that combines both legal and insurance advice and includes:

  • Reviews of your contracts in conjunction with your insurance policies placed through Perrymans
  • Advice on contract conditions, together with recommended amendments to both the contract and/or insurance covers
  • Provision of a single referenced risk management document, which identifies problematic clauses requiring attention for use in your negotiations with your client.

Bastiaan Sparreboom is a former partner of Phillips Fox and Fox Tucker. He has practised insurance law for more than 30 years, acting for both insurers and insureds. In 2012 and 2013 he was voted as one of Australia’s best lawyers in the field of insurance. His industry expertise focuses within the construction and professional services sectors.

Clients can either elect to opt for a set amount of reviews per annum or can access this service on a ‘contract by contract’ basis.

We believe this to be an invaluable cost effective risk management tool for our clients.

At Perrymans we see claims management and advice as one of the most important aspects of our service.

Whilst many of our competitors opt to pass this aspect to the insurers to handle, we work with you, the adjusters, legal counsel, insurers and advisors to achieve the right outcome.

Whether it is a professional liability matter or burglary we know the sooner we resolve your claim, the sooner you can get back to business.

The Perrymans system for managing your claims is to:

  • ensure that you are provided with the most efficient and cost-effective claims handling procedures
  • be proactive in managing the process to ensure that all claims are handled in accordance with the priority agreed with you
  • provide all relevant information to keep you up to date on claims progress
  • ensure settlements are in accordance with specification and maximise your claim entitlement
  • explain insurer rationale in the setting of claim estimates and settlements
  • vigorously pursue every possible avenue of recovery
  • not perform as a post office
